Opening and Welcome by Vice Mayor:
Vice Mayor Ruby Coleman opened the meeting, welcomed council to the April 22,2021 Budget Workshop FY 2021-22. Vice Mayor Ruby Coleman asked council to face the flag for the pledge of allegiance, and asked for a moment of silence.
Budged Workshop Agenda:
Vice Mayor Ruby Coleman asked for council to view their agenda and if anyone wanted to add anything to the agenda; no additions were made.
Approval of the Agenda:
Vice Mayor Ruby Coleman asked for a motion to approve the agenda; Herbert Branham made a motion to approve the agenda; Jelane Mock seconded the motion; a vote was taken and all members were in favor.
Discussion of FY 2021-22 Budget:
Greg Baker addressed council in the procedural process of completing the budget. Greg addressed council on the line items that are included in the budget. Greg explained the process of what kind of advertising that needed to be done so council can have a public hearing then in June council will be able to vote on the FY 2021-22 Budget. Greg advised council to discuss the taxes. What taxes council wants to change and imposed. Council discussed each tax revenue item. Jelane Mock made a motion to increase cigarette tax from 5 cents to 10 cents per pack of cigarettes for the Town of Clinchco next FY 2021-22 it will be advertised in the paper and a public hearing for the increase in May 2021. Cynthia Ellis seconded the motion; a vote was taken and all members were in favor.
Greg Baker discussed the business license matter with council and the procedure that would be taken with business each year and if a business started in the middle of they year. Greg discussed with council the fee amount that could be charged to the business for purchasing the business license. Contractors - $30.00 first $20,000 and .15 per hundred after first $20,000. Retail Services - $30 first $20,000 and .15 per hundred after first $20,000. Financial & Real Estate Services - $30 first $15,000 and .20 per hundred after first $15,000. Professional Services - $30.00 first $15,000 and .20 per hundred after first $15,000. Repair, Personal, & Business - $30 first $20,000 and .15 per hundred after first $20,000. Wholesale .05 per hundred after first $60,000. Discussion was made of what date to send out letters to renew license. Peddler License $500.00. Itinerant Merchant - $200.00. Discussion was made of each category and what the business would fall under. Jelane Mock made a motion to impose the Business License fees at the rates that were discussed and run the advertisement in the paper; Herbert Branham seconded the motion; a vote was taken and all members were in favor.
Greg Baker discussed with council utilities tax. Greg stated he plans on talking to our representee to see if the town of Clinchco can impose that tax. Other discussion was made of how much utility tax could possibly be imposed by the town.
Discussion was made of yard sale; if a group set up to yard sale for a church how would that fee apply; Greg stated they would be charged individually for a set up fee.
Jelane Mock asked about the smokeless tobacco; Greg Baker advised the town cannot tax that. Other discussion was made of other tabacco.
Council discussed possibly raising the hot meal tax; it was decided to wait that at this time.
Vice Mayor Ruby Coleman discussed the possibility of the town selling hunting and fishing license and if we sell them we will receive a $1 for each license we sell. Vice Mayor Ruby Coleman stated that she will send Greg the information to let him look at it first. Herbert Branham made the motion that after the town attorney looks at the paperwork and gives his okay, then the town hall will start selling hunting and fishing license; Jelane Mock seconded the motion; a vote was taken; Herbert Branham voted yes, Stearl Branham voted yes, Jelane Mock voted yes, Vice Mayor Ruby Coleman voted yes, Cynthia Ellis voted yes; Trevor Counts voted no.
Vice Mayor Ruby Coleman asked for any more discussion; no other discussion was made.
Executive Session:
Vice Mayor Ruby Coleman asked for a motion to go into executive session; Jelane Mock made a motion that council enter into closed session under Virginia state code 2.2-3711, A1 Personnel matters; A7 consult with legal council. Stearl Branham seconded the motion; a vote was taken and all members were in favor.
Jelane Mock made a motion under Virginia state code 2.2-3312 that to the best of my knowledge only public business matters that were identified in the motion were heard, discussed, or considered in the meeting by town council; Stearl Branham seconded the motion; a vote was taken and all members were in favor.
Roll Call Vote: Jelane, yes; Herbert Branham, yes; Stearl Branham, yes; Vice Mayor Ruby Coleman, yes; Cynthia Ellis, yes; Trevor Counts, yes.
Open Session:
Vice Mayor Ruby Coleman brought council back into open session for the FY 2021-22 Budget workshop.
Jelane Mock made a motion to pay the town clerk $15.25 an hour, with Labor Day, Memorial Day, July 4th, Christmas, 2 days for Thanksgiving, and Election Day. These days will be paid Holidays. Two weeks paid vacation, no overtime, the town attorney will write up a contract with liquidated interest clause act in the event the employee violates the terms and condition of the contract. The contract will run until December 31, 2024 and will be subject to renegotiate at that time. This will be offered to the current clerk and if it is not accepted then the Vice Mayor has permission to advertise the position under the same terms and conditions stated in the motion. Vice Mayor Ruby Coleman stated that the week sick time that she already has was left out of the motion; town attorney greg baker stated that was okay, it wasn’t necessary since she already receives sick time it would be included in the contract. Stearl Branham seconded the motion. Jelane Mock amended the vote to include all that was previously stated and a week sick time; a vote was taken and all members were in favor.
Public Comments:
Vice Mayor Ruby Coleman asked for public comments and gave a number out loud to for anyone wanting to call in; no public comments were made.
Council Comments:
Vice mayor Ruby Coleman asked for council comments; no council comments were made.
Recess:
Jelane Mock made a motion to recess until April 30th; Stearl Branham seconded the motion; a vote was taken and all members were in favor.
