HOUSING MEETING

MINUTES OF MEETING ON 11/16/2017

 

MEMBERS PRESENT: Chairman Jarvis Deel, Don Hill, Trevor Counts, Virginia White, Ralph Sutherland, Tina Deel

MEMBERS ABSENT 11/16/2017:  Frankie Gulley, Randy Moore

Town Attorney: Susan Woods

Town Clerk: Tina Deel

On 11/16/2017 the meeting was called to order by Chairman Jarvis Deel.

Welcoming and moment of silence:

Chairman Jarvis Deel, welcomed everyone to the meeting and called the meeting to order, and asked for a moment of silence. 

Approval of Minutes:

Chairman Jarvis Deel asked if everyone has had a chance to look over their minutes; Trevor Counts made a motion to approve the minutes; Don Hill seconded the motion; a vote was taken and all members were in favor. 

Approval of the Treasurers Report:

Chairman Deel asked if everyone has had time to look at their treasurer’s report; Don Hill made a motion to approve the treasurer’s report; Ralph Sutherland seconded the motion; a vote was taken and all members were in favor.

Additions to the agenda:

Chairman Deel asked if anyone had any additions they wanted to make to the agenda; Don Hill asked to add to the agenda the potential of a small business coming to Clinchco; Chairman Deel stated that would be council meeting, not the housing for that discussion.  Don Hill agreed.  Ralph Sutherland stated he would like to discuss what we are going to do about the houses; Chairman Deel stated that was already on the agenda under closed session.  Trevor Counts made a motion to approve the agenda; Virginia White seconded the motion; a vote was taken and all members were in favor. 

Old Business:

No old business was discussed.

New Business:

Closed Session:

Chairman Deel stated at this time he would ask for a motion to go into closed session under code section 2.2-311 section 7.  Ralph Sutherland made the motion to go into closed session; Don Hill seconded the motion; a vote was taken and all members were in favor.

Open Session:

Chairman Deel stated at this time they will come back into open session under code section 2.2-3712, paragraph D.  We were in closed session under legal matters, section 7.  I would like to have a motion that we come back into open session.  Ralph Sutherland made the motion to come back into open session; Don Hill seconded the motion; a vote was taken and all members were in favor.  Chairman Deel asked for a motion that all was discussed in closed session was legal matters.  Trevor Counts made the motion that legal matters were discussed in closed session; Ralph Sutherland seconded the motion; a vote was taken and all members were in favor.

Don Hill made the motion that we go through a financial evaluation with these 10 people and take a look at what we got and make a decision from there on those 10 people.  To my understanding Susan, we have some other people that have zero payments.  Susan stated yes, to my understanding by looking at the documents.  Don stated regardless of how many people are there; there is no way for us to collect on those people at all.  Susan agreed, Don stated it says in the Deed of Trust is says zero payments.  Somebody really….I don’t want to be rude but, someone messed up and we don’t have a leg to stand on, the deed of trust says zero payments on it.  Ralph Sutherland stated on that one there….Don stated in that one phase and we can’t collect on them and Ralph agreed.  Don stated the motion for financial statements and the ones that state zero payments we can have Susan prepare a certificate and send it to them; release certificates.  Don amended his motion to include the homes where the original owners have passed away.  Chairman Deel stated we have a motion on the table right now for an evaluation on 10 people and also to include people moving into peoples homes that have expired, and also to include in the motion for the zero dollar deed of trusts to let Susan release those deed’s that have zero dollars on it; Trevor Counts seconded the motion; a vote was taken and Trevor Counts voted yes, Virginia White voted yes, Don Hill voted yes, Jarvis Deel voted yes, and Ralph Sutherland voted no.  Ralph Sutherland discussed why he didn’t feel we should clear the deeds and give it back to the owners.  Don Hill disagreed, and stated that there was no way we could collect on zero payments.  Ralph Sutherland made a motion that have the lawyer go forward, we pick out a name on the list; the one that owes the most money and let the lawyer go into legal procedures to foreclose on it.  Chairman Deel stated discussion wise; do we not have one already in progress with that; Don Hill and Susan agreed that the Town does.  Susan stated it has been tabled at this time as we try to figure things out.  Susan discussed how she has started the procedure and has it saved on her computer but, it was decided to table the matter due to various issues.  Ralph made the motion for Susan to continue paper work on the foreclosure.  Chairman Deel stated I have a motion from Ralph Sutherland on going forward on the same house that we are already working on and had tabled back a couple months ago; Don Hill seconded the motion; a vote was taken and Trevor Counts voted yes, Virginia White voted yes, Don Hill voted yes, Ralph Sutherland voted yes, Chairman Jarvis Deel voted no.

Housing Member Comments:

Tina stated for the members to please take note and correct the name on the treasurer’s report. 

Adjournment:

Don Hill made the motion to adjourn; Ralph Sutherland seconded the motion; a vote was taken and all members were in favor.
