COUNCIL MEETING

MINUTES OF MEETING ON JUNE 21, 2018

MEMBERS PRESENT: Mayor Jarvis Deel, Stearl Branham, Herbert Branham, Don Hill

MEMBERS ABSENT:  Vice Mayor Ralph Sutherland, Trevor Counts, Virginia White

TOWN CLERK: Tina Deel

TOWN ATTORNEY:  Susan Wood

 

Call to Order & Welcome by Mayor

Mayor Jarvis Deel welcomed everyone and called the meeting to order and asked for a moment of silence.

Approval of Minutes

Mayor Jarvis Deel asked if everyone has had time to look at the last minutes and if there is any discussion over the minutes.  Mayor Jarvis Deel stated that he had some discussion on the minutes; the statement I made last meeting; we need to amend the minutes about the road cost estimate; I said $700,000.00, but what I meant to say was $70,000.00.  The minutes need to be amended on the discussion of the town roads to $70,000.00 as the estimate.  Don Hill made a motion to accept the minutes as amended; Herbert Branham seconded the motion; a vote was taken, and all members were in favor.

Approval of Treasurers Reports

Mayor Jarvis Deel asked if everyone has had a chance to look at their treasurer’s reports; the Police Department and the General Account; and if there is any discussion on the treasurer’s report; Don Hill stated he had a question on the General Account; these repairs were they for the bathroom at the ball field; Mayor Deel stated yes; Don stated is there any way to recover those; Mayor Deel stated yes, were we caught them, we will be getting restitution.  Mayor Deel asked for any more comments; Don Hill stated we are still not collecting in the way of tickets; Mayor Deel stated no, not yet, but I can update you when we get down to the old business. No more discussion was made; Herbert Branham made a motion to accept the treasurers’ reports; Don Hill seconded the motion; a vote was taken, and all members were in favor.

Agenda:

Mayor Deel asked for any additions to the agenda; Don Hill stated yes, he would like to add the subject of paying Jarvis Deel's cell phone bill, since he carries it around 24hrs a day and takes calls for the town and probably some other personal business, but most of it will probably be town business.  Don Hill made a motion to pay Jarvis cell phone bill; Mayor Deel stated we will move that down to under new business to #5.  No more additions were made.  Herbert Branham seconded the motion; a vote was taken, and all members were in favor.  Mayor Deel stated motion passed to put it under new business under #5.  Don Hill made a motion to approve the agenda; Stearl Branham seconded the motion; a vote was taken, and all members were in favor.

Old Business:

Update on Ball Field:

Mayor Deel stated the update on the ball field; is that we the doors secure now.  We put the new vanity and sink in the ladies’ room; re-done all the plumbing and finally got caught back up with the grass.  We caught who done it on tape and we have the person admitting it to the officer that they done it, so we shouldn’t have any problem when we go to court with it.  Don Hill asked how would we recover that money; Susan stated it is restitution through the court you have to prove what the damages are, and that person has to pay the restitution.  Don asked how old this person was; Mayor Deel stated he is probably 17.  Don asked any way to pay this; Mayor Deel stated they will put him on community service or something.  Don stated we actually won’t recover money.  Mayor Deel stated well yeah, he won’t be doing community service here that will be somewhere else and what money goes into the court will come to us. 

New Business:

Update on the Police Department:

Mayor Deel stated that Coojo is supposed to bring his stuff down sometime next week, he hasn’t had time right now.  We will be moving Richard to Chief of Police position, and I know you all know Chris Yates…. he is supposed to come down and apply on Monday and if we hire him, I can have him for 29 hours a week.  Terry Montgomery was going to come and shut us down, he is over all the police departments.  But Richard made a phone call and let him know everything.  Things are on the right track now and everything is cleared up with him and we are in the process of rebuilding.  Discussion of the Cop Grant was discussed to hopefully get a full-time officer.  Mayor Deel explained to the council how the grant worked.

Car Show:

Mayor Deel stated that he would start trying to see what he could get together, so we can have a car show.  I am going to talk to a few people around here, so we don’t bump or contradict with another car show that will be going on.

Town Roads:

Update on town roads is that I did talk to Mike Gulley and he said he will fill the potholes out here on the Old Post Office Road.  We will wait until he gets done then we can see how much gravel we may need. 

Budget:

Mayor Deel stated we will need to vote on our budget.  Before we vote on the budget we have to vote on our tax rate; our real estate tax is at .10, 2018-19 the tax rate will remain the same .10 with no purposed increase.  At this I would like to ask for a motion for a roll call vote to vote on it and the tax rate to remain the same.  Don Hill made a motion to accept the rate as is; Herbert Branham seconded the motion; a vote was taken, and all members were in favor.

Mayor Deel stated at this time I would like to have a motion for a roll call vote on our budget;

Herbert Branham made a motion for a roll call vote on the budget; Don Hill seconded the motion to approve the 2018-19 budget; a vote was taken, and all members were in favor.

Mayor Deel stated even with what members are absent we still have enough members for a

46.2 Motor Vehicle Code:

Mayor Deel stated we had our public hearing regarding the 46.2 Motor Vehicle Code of Virginia 1950 as amended as a motor vehicle law for the Town of Clinchco and a copy of said ordinance shall be placed in the offices of the Town Clerk, the Clerk of Dickenson County Combined District Courts and the Clerk of the Circuit Court to become effective July 1, 2018.  Now I will need a roll call vote on us adopting this amendment on the ordinance.  Don Hill stated so moved; Stearl Branham seconded the motion; a vote was taken, and all members were in favor.

Releasing Deeds of Trust:

Mayor Deel stated at this time we need to take a vote on releasing the liens on the Deeds of Trusts held by the town.  This is a process to help us move forward.  We have talked to the DHCD and they will forgive us anything the town would have been charged with.  They think it is a better idea for us to do this and we can move forward and apply for another grant for our blight, infrastructure and things like that.  Don Hill made a motion to release the liens on the deeds of trust held by the Town of Clinchco for all those people who received housing help under the grant; Stearl Branham seconded the motion; a vote was taken, and all members were in favor.

 

Cell Phone Bill:

Mayor Deel stated at this time I will ask for a motion to pay my cell phone bill.  Herbert Branham made a motion to pay the bill; Susan asked if there was a certain amount that needs to be put on the payment of the bill.  Mayor Deel stated it is always the same.  Don Hill seconded the motion; a vote was taken, and all members were in favor.  Mayor Deel stated he really shouldn’t vote; Don Hill stated to just recuse yourself; Susan stated if he does that, do you have a quorum; Don Hill stated good observation.  Don asked can he just abstain; Susan stated I don’t know what to tell you on that for sure; I guess it would be ok, I mean.  Don Hill stated well vote yourself Mr. Mayor.  Mayor Deel voted yes.
